Criminal Code: Sections 322 and following

Theft

Overview

Armed robbery, as defined by the Criminal Code, occurs when a person uses or threatens to use force to commit theft, extort property, or prevent any resistance. If the assailant injures or threatens to injure the victim to steal from them, this is also considered armed robbery. Additionally, the mere possession of a weapon, or an imitation weapon, during the theft constitutes an aggravating factor that falls under this category.

Legal Consequences

Armed robbery is severely punished by the Criminal Code, with the possibility of life imprisonment. Although not all convictions result in such a sentence, this reflects the seriousness of the crime. In certain situations, such as the use of a restricted or prohibited firearm, a mandatory minimum sentence of 5 years of imprisonment is imposed.
