Sexual Assault
Criminal Code: Section 271
Sexual Assault
Overview
Sexual assault occurs when an individual intentionally makes sexual contact with another person, knowing that the person does not consent, or acting with recklessness or willful blindness to the lack of consent (R. v. Ewanchuk, 1999 1 SCR 330). This offense covers a wide range of behaviors, from inappropriate touching to more serious assaults, thereby emphasizing the importance of clear and explicit consent in any sexual interaction.
Legal Consequences
The maximum penalty for a sexual assault charge is 10 years of imprisonment when the victim is over 16 years old. However, if the victim is under 16, the maximum penalty is 14 years, with a minimum sentence of one year in prison. This distinction highlights the seriousness of offenses involving minors, reflecting the legislature’s commitment to protecting young people from all forms of assault.
