Criminal Code : Section 320.16
Hit and Run (Failure to stop after accident)
Overview
What is a hit and run? If you are involved in an accident and leave without stopping to provide your information or offer help, you are committing a hit and run. The law requires you to identify yourself and assist the people affected. What is an accident under the Code? An accident is any incident where a vehicle causes damage to a person or another vehicle. Whether intentional or not, you must stop, identify yourself, and, if necessary, offer assistance.
Legal Consequences
The legal consequences of a hit and run vary depending on the severity of the incident. If the hit and run results only in property damage, penalties may include fines and a driver’s license suspension. However, if the act causes bodily harm or, worse, death, the penalties are much more severe. In such cases, prison sentences, significant fines, and long-term driving bans are often imposed.
