Forcible Confinement
Criminal Code : Section 279 (2)
Forcible Confinement
Overview
Forcible confinement occurs when a person exerts physical restraint on a victim, preventing them from moving freely. For example, if someone blocks the exit door of a room, preventing the other person from leaving, this constitutes forcible confinement, as the victim is deprived of their freedom to escape.
Legal Consequences
The legal consequences of forcible confinement can be severe, with penalties of up to 14 years in prison. If the offense involves violence or lasts for an extended period, the penalty may be increased. Furthermore, after serving their sentence, the accused may face probation conditions that impose restrictions during their rehabilitation. In the event of reoffending, the penalty will be significantly enhanced. Each case being unique, the specific consequences will depend on the details surrounding the offense.
